Terms of Service

Welcome to BahariPOS, a Point of Sale (POS) and business management platform operated by Huam Technology ("Company", "we", "us", or "our"), registered in the United Republic of Tanzania.

By accessing or using BahariPOS—whether through our website, mobile application, or any related services—you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use our services.

These Terms constitute a legally binding agreement between you ("User", "Customer", or "you") and Huam Technology under the Law of Contract Act, Cap 345 of Tanzania.

BahariPOS provides cloud-based Point of Sale and business management software, including but not limited to:

• Retail, Restaurant, Pharmacy, Fuel Station, E-commerce, and Production POS systems
• Inventory management, sales tracking, and reporting
• Staff, customer, and supplier management
• Mobile money integration (M-Pesa, Tigo Pesa, Airtel Money)
• Multi-branch management and offline capabilities
• Receipt printing, SMS, WhatsApp, and email notifications

We reserve the right to modify, suspend, or discontinue any part of the service at any time, with reasonable notice to users.

To use BahariPOS, you must:

• Be at least 18 years of age
• Have the legal capacity to enter into binding contracts
• Be a registered business or an individual operating a lawful business in Tanzania (or any jurisdiction where we operate)
• Not be prohibited from using our services under any applicable law

When you create an account, you agree to:

• Provide accurate, current, and complete information
• Maintain the security and confidentiality of your login credentials
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized access or security breach

We reserve the right to suspend or terminate accounts that violate these Terms or pose a risk to other users or the platform.

BahariPOS operates on a subscription basis. By subscribing, you agree to:

• Pay all applicable fees as described on our Pricing page
• Accept that fees are quoted in Tanzanian Shillings (TZS) and are inclusive of applicable taxes unless stated otherwise
• Understand that subscriptions auto-renew unless cancelled before the renewal date
• Acknowledge that we may change pricing with at least 30 days' prior notice

Refund Policy: Unless required by law, subscription fees are non-refundable. We may, at our discretion, offer prorated refunds in exceptional circumstances.

New users may be eligible for a 14-day free trial. At the end of the trial:

• You must subscribe to continue using paid features
• Your data will be retained for 30 days after trial expiration
• We reserve the right to modify or discontinue the trial at any time

You agree NOT to:

• Use BahariPOS for any illegal, fraudulent, or unauthorized purpose
• Upload malicious code, viruses, or harmful content
• Attempt to hack, reverse engineer, or disrupt our services
• Share your account credentials with unauthorized persons
• Use the service to transmit spam or harass others
• Violate any applicable Tanzanian law, including the Electronic and Postal Communications Act and the Cybercrimes Act, 2015

We are committed to protecting your personal data in compliance with the Personal Data Protection Act, No. 11 of 2022 of Tanzania. Our data handling practices are detailed in our Privacy Policy, which forms part of these Terms.

By using BahariPOS, you consent to the collection, processing, and storage of your data as described in the Privacy Policy.

All content, software, designs, logos, and trademarks associated with BahariPOS are the exclusive property of Huam Technology and are protected by Tanzanian and international intellectual property laws.

You retain ownership of the business data you upload to BahariPOS. We are granted a limited license to process this data solely to provide our services to you.

To the maximum extent permitted by Tanzanian law:

• BahariPOS is provided "as is" and "as available"
• Huam Technology shall not be liable for any indirect, incidental, or consequential damages
• Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim
• We are not liable for losses due to internet outages, third-party payment failures, or force majeure events

Either party may terminate this agreement:

• You: At any time by cancelling your subscription
• Us: With 30 days' notice, or immediately if you breach these Terms

Upon termination, you may export your data within 30 days. After this period, data may be permanently deleted in accordance with our data retention policy.

Any dispute arising from these Terms shall first be resolved through good-faith negotiation. If unresolved within 30 days, the dispute shall be submitted to mediation in Dar es Salaam, Tanzania, or to the competent courts of Tanzania.

We may update these Terms from time to time. Material changes will be communicated via email or an in-app notice at least 30 days before they take effect. Continued use of BahariPOS after changes become effective constitutes acceptance of the revised Terms.
